Terms of Service

These Terms govern your use of the Pro Pick ’Em website and application (the “Service”). By creating an account or using the Service, you agree to them.

The Service

Pro Pick ’Em provides tools for organizing and participating in pick ’em competitions. Players join and play free. Creating and running a league requires the season purchase shown before checkout.

Pro Pick ’Em does not operate a sportsbook, accept wagers, hold prize funds, or guarantee prizes. League organizers are responsible for their rules, prizes, and legal compliance.

Accounts and conduct

Provide accurate information, safeguard your password, and promptly report unauthorized access. Do not bypass access controls, misuse another account, interfere with the Service, upload malicious material, harass others, impersonate anyone, or use the Service unlawfully.

League roles

Commissioners control their leagues, including settings, invitations, and activation. Players are responsible for submitting picks before applicable deadlines.

Purchases

Payments are processed by Stripe. Pro Pick ’Em does not receive or store full card numbers. A new paid league is created only after a verified Stripe payment webhook. Refunds follow our Refund Policy.

Availability

We work to keep the Service accurate and available, but interruptions and errors may occur. We may maintain or change the Service and may suspend access to protect users, the Service, or legal rights.

Ownership

The Service, branding, design, and software belong to Pro Pick ’Em or its licensors. You may use them only for the Service’s intended purpose.

Disclaimers and liability

The Service is provided “as is” and “as available” to the extent permitted by law. We do not guarantee any pick, result, ranking, prize, or uninterrupted operation. To the extent permitted by law, Pro Pick ’Em is not liable for indirect, incidental, special, consequential, or punitive damages. Nothing here limits rights or liability that cannot legally be limited.

Governing law

Texas law governs these Terms, without regard to conflict-of-law rules, except where applicable consumer law requires otherwise.

Pro Pick ’Em is operated by James H. Smith, an individual in Texas.
“Pro Pick ’Em” identifies the service and business operating name. No LLC, corporation, or other registered-entity status is claimed.
